This Privacy Policy regulates the processing of personal data belonging to Users and Customers, collected during the use of the website www.qarint.com (hereinafter referred to as the “Website”) and Qarint mobile applications (hereinafter referred to as the “Application”), and/or during online services subject to a contract.

QARINT TEKNOLOJİ HİZMETLERİ A.Ş. (hereinafter referred to as “Qarint”) is the owner of the Website and the Application. It is responsible for the data collected through the Website and the Application. Qarint ensures compliance with the applicable legislation on the protection of personal data, adherence to the Personal Data Protection Law No. 6698 regarding the protection of individuals in the processing of personal data, and guarantees the free circulation of such data in accordance with the Personal Data Protection Law No. 6698, enacted on April 7, 2016, which enforces its implementation through national legislation.

The use of the Website or the Application signifies acceptance of this Privacy Policy.

Nevertheless, Qarint agrees and undertakes to comply with the data protection laws of the European Union and the Republic of Turkey. By accepting this Privacy Policy, the User and Customer are deemed to have consented to the processing of their data in countries that may not be subject to the same data protection laws as Turkey.

II. Principles Applicable to Data Processing

Qarint will apply the following principles, which are compliant with the requirements of applicable data protection norms, when processing your personal data:

    Principle of legitimacy, loyalty, and transparency: Qarint will always have a legal basis for processing data, with one or more specific purposes, and will communicate these purposes in advance with full transparency.

III. Collection of Personal Data

When Users and Customers visit the Website and Application to reach Qarint via the contact number, send an email, subscribe to its newsletter, or sign a contract, they provide information containing personal data such as IP address, first and last name, address, email address, phone number, age, etc. Users and Customers may, in particular, provide personal data through the Website and Application by performing the following actions

  • Browsing the Website or Application.
  • Contacting via contact forms or sending an email. Submitting a comment on an article or page on the Website or Application.
  • Entering into a contract for services offered by Qarint.
  • Filling out a subscription form or newsletter form belonging to Qarint via MailChimp.
  • Filling out a subscription form or newsletter form belonging to Qarint via the Website.

As a result of these actions, the categories of personal data collected through the Website or Application are as follows:

  • Personal Data For example: first name, last name, etc. Additionally, during the recording of lessons, images may also be collected for security and service quality purposes.
  • Data related to demographic characteristics. For example: country, age, etc.

  • Contractual data For example: data related to contractual transactions, purchased products and services, financial transactions, etc.

IV. Purpose and Legal Basis for Processing Personal Data

The personal data collected and the purpose for which Qarint processes this data vary depending on the methods of data collection:

  • Contact forms: Qarint requests personal data such as first and last name, email addresses, phone numbers, and age to respond to inquiries. Qarint may use this data to enable Users or Customers to access information on the Website or Application, the services provided, legal documents available on the Website or Application, contract terms, and to respond to messages, questions, complaints, or comments they submit regarding the processing of their personal data. The legal basis for data processing is the consent given by the data subject when filling out and submitting the contact form or when speaking with a Customer Representative over the phone.

  • Content subscription forms: Qarint requests the following personal data to manage a subscription list and send newsletters, promotions, and special offers: first and last name, email address, phone number, and age. The data provided by the User or Customer to Qarint during the completion of the forms is stored on servers owned by Hetzner Online GmbH, located in Germany. The legal basis for data processing is the consent given by the data subject when filling out and submitting the contact form.

  • Contract process: Qarint may request personal data from Users and Customers to formalize pre-contracts or contracts, manage collections and payments for purchases made, provide products and services, etc., and the legal basis for processing this data is the contract negotiations and the contract itself.

  • Satisfaction surveys: Qarint may send satisfaction surveys and quality surveys regarding the services it provides via electronic means (email, SMS, MMS, etc.), telephone, or postal systems. The legal basis for processing data for the purposes specified in this section is Qarint’s legitimate interest.

Qarint also processes the personal data of Users and Customers for the following purposes:

  • To ensure compliance with the conditions specified in the Terms of Use and applicable laws. This may include the development of tools and algorithms that help ensure the confidentiality of personal data collected by the Website or Application. The legal basis for these activities is Qarint’s fulfillment of its obligations.

Under no circumstances will Qarint use the profiles of followers on social media to send individual advertisements.

V. Security of Personal Data

Qarint has taken all reasonable measures and followed the best practices in the industry to protect the User’s or Customer’s personal data, preventing their loss, misuse, unauthorized access, disclosure, or alteration.

The Website is hosted on Hetzner Online servers in Germany. If lessons are recorded, they are hosted on Hetzner Online servers in Germany, Amazon Web Services servers in the United States, and Google Play and AppStore servers. The security of the data is guaranteed as all necessary security measures have been implemented for this purpose. VI. Content of Other Websites

Pages on the Website or Application may contain links to content from other websites (e.g., videos, images, articles, etc.).

As a result, these other websites may collect User and Customer data, use cookies, embed additional third-party tracking code, and monitor interactions through this code. The processing of personal data collected by these websites is subject to the provisions of their own privacy policies.

VII. Cookie Policy

The Website or Application uses cookies that enable the operation and provision of the services offered on it. Information regarding the types of cookies, their purposes, and configurations is provided in the Cookie Policy.

VIII. Retention of Personal Data

The personal data provided by Users or Customers to Qarint will be retained for as long as necessary to achieve the purposes for which they were collected and processed, provided that Users or Customers do not exercise their right to deletion.

If the data is no longer necessary to achieve the purposes for which it was collected and processed, it will be deleted, except in cases where processing must temporarily continue to comply with a legal provision. Similarly, personal data will be deleted if Users withdraw their consent, except in cases where one of the exceptions provided by law applies.

IX. Recipients of Personal Data

Qarint may transfer or allow access to personal data collected through the Website or Application to the following recipients:

a) Service providers:

Qarint may grant access to personal data to companies providing services under a contract if it is necessary to fulfill the purposes outlined in this Privacy Policy, such as application services, web platform services, etc. These service provider companies must process the data in accordance with the conditions set by applicable laws and under a third-party data processing agreement that ensures all obligations necessary for the proper processing of the data are fulfilled.

In particular, Qarint will allow the following providers to access personal data

  • Agora Lab, Inc., which processes this data to record live sessions conducted for Qarint’s service provision.
  • Iyzico (İyzi Ödeme ve Elektronik Para Hizmetleri A.Ş.), which processes personal data in connection with providing payment services to Qarint.
  • Hetzner Online GmbH, Germany, which processes data in the context of data hosting services provided to Qarint.

b) Other third parties and compliance with legal obligations:

Qarint may transfer personal data to third parties if it is necessary to fulfill a legal obligation, including transmission to authorized authorities, judges, and courts.

Qarint may allow other companies, referred to as third-party advertisers, ad servers, or ad networks, to serve advertisements within the Service. These third-party advertisers, ad servers, or ad networks use technology to send advertisements and links appearing in the Service directly to your browser. When this happens, they automatically receive your IP address. In such cases, you should refer to the privacy policies of the respective third-party advertisers, ad servers, or ad networks. Qarint’s Privacy Policy does not apply to such advertisers, ad servers, ad networks, or other websites, and Qarint cannot control their activities.

XI. Accuracy and Truthfulness of Personal Data

Users and Customers undertake to ensure that the data provided to Qarint is accurate, complete, truthful, and valid, and they also commit to keeping it duly updated.

As a user of the Website or Application, the User and Customer are solely responsible for the accuracy and truthfulness of the data provided, which exempts Qarint from any liability in this regard.

XII. User/Customer Rights

Qarint informs the User and Customer that they have the following rights regarding their personal data:

  • Request access to the stored data.
  • Request the correction, deletion, or destruction of their data. Request the restriction of data processing.
  • Object to the processing of their data.
  • Right to data portability.
  • Right to know whether their personal data is being processed.

Qarint reserves the right to amend this Privacy Policy to adapt it to legal or regulatory changes, as well as to industry practices.

This Privacy Policy will remain in effect until it is amended by another duly published policy.
